The short story behind it…

Before we created our own addon,  Dugi Guides used an Open Source software called TourGuide which served as the addon to read our guides in-game.

We had written permission from the author to use the TourGuide addon commercially and we supported the author with donations.

Then about this time 2010 a small gnome by the name of Zygor and his lawyer came to our doorstep and filed a DMCA notice, claiming that he is now the owner of TourGuide and demanded that Dugi Guides pay damages of  $75,000 USD or else we will face a much bigger lawsuit of $150,000 per Copyright Infringement + legal costs.

We discovered later that the ownership rights of  TourGuide was sold to Zygor a couple of months earlier for a undisclosed sum of money.

Zygor then removed all distribution of TourGuide from other websites such as Curse and WoWInterface which prevented anyone from downloading TourGuide.  Without the ability to download TourGuide from anywhere our users were unable to use our guides with TourGuide, which also prevented us from selling our guides.

Dugi Guides would have still been able to distribute TourGuide but we took the matter very seriously and we were forced to close our store for about 3 weeks until we finished creating our own addon and were absolutely certain about our position.

During this time the folks from Zygor posted announcements in their newsletter, forum publicly stating that their intentions with TourGuide was to implement it with their addon and nothing else. Zygor claimed that Dugi Guides was breaking the law and they are just following proper legal procedure and the threats from their lawyer continued to come.

Zygor himself also continued to spread false statements in our own forum and blog by posting under several different names which we later discovered.

Once we were given the all clear from our lawyer, we posted all the facts and clearly proved that we were within our right to distribute TourGuide as it was an Open Source software and that we have permission from the author.

What happened since then…

Our deadline to pay $75,000 to Zygor was 31st March 2010 and we didn’t give them a single dime. Zygor and his lawyer were never heard from again since our last statement.

Zygor never implemented TourGuide with their own addon.

TourGuide was made available to the public again without any announcement.

Zygor removed all the defamatory statements against Dugi Guides from their forum.

Zygor made no statements to defend any of his actions against Dugi Guides

We also believe that Zygor no longer owns the rights to TourGuide and  TourGuide has been returned back to the original author and it is currently no longer updated or used.

Moving on…

I have to admit the entire event came as a shock and was very distressing to us, something like this has never happened to us before and we didn’t know how to handle it.  We were a relatively small company VS a company that was about 5x times bigger than us that had disposable income for Lawyers and buying out TourGuide. We fought back by involving the public so that our customers knew what was going on. I believe that the support we received and the backlash towards Zygor, helped play a part in their decission to back away.

But we were also glad it happened because it was a major turning point for our company. All the support  from the public really drove us to work harder.

We have moved on since then but we will highlight this event once a year until we receive some form of public acknowledgement from Zygor that their actions were wrong.

What can you do to help…

We believe that a  large company like Zygor should fulfill their corporate responsibility and behave in an ethical manner. Without smaller companies like Dugi Guides offering alternative products then the consumer loses out. Innovations suffer and Zygor could continue to charge $100 for their leveling guides.

No matter how good their products are, it should be clear that their actions will not be tolerated and not something that they can sweep under the rug to forget about.

The money spent on TourGuide and Lawyers could have been better spent on improving their products or passed on as savings to their customers or other positive causes.

You can help by not supporting Zygor Guides and sharing this article  and try to get a real explanation from Zygor regarding their actions towards Dugi Guides.

Our statement we posted in our blog was left completely unchallenged.

Zygor instead have removed their public defamatory statements from their forum against myself and UltimateWoWGuide.com and we never heard from them again.

We also have good reason to believe that the TourGuide license to Zygor has already expired on May 2nd and that TourGuide has now returned back to Tekkub’s ownership, refer to the screenshots below.  Tekkub has removed the ZygorGuides.com notice on his GitHub, WoWInterface and Curse page on May 2nd.

As Tekkub has mentioned on his website “if the deal ends in the future, rights will return to me”

I contacted Tekkub to confirm this and I requested him to tell us the full story, however this is the only response that I have received.

Hi Tekkub, now that the contract is over are you able to comment at all and fill us in on the full story? would you mind an interview?

Frankly, I just want to move on. You have your new version of your guide, Zygor has whatever, everyone is happy(ish).

Tekkub didn’t respond to any more of my follow up emails.

Without any further communication from Tekkub or Zygor, I’m not able to confirm this to be 100% true, but Tekkub’s last email neither confirmed or denied that the contract is already over, however the evidence above  suggests that the contract is finished.

We also have evidence that Zygor has been posting on our forum and blog pretending to be a regular disgruntled customer during our troubled times.  Zygor did try to hide his true identity by using a different name and email to create an account with UltimateWoWGuide, but our evidence shows with 100% certainty that this person is none other that Zygor (John Cook) himself, as we manage to trace him using his past refunded receipts and ip address which leads back to his full name and home address in Ohio.  Please refer to the screenshots below for examples of his posts while we were working hard to build a better addon to replace TourGuide.

Against all odds UltimateWoWGuide still fulfilled our promise to our customers.  Within a few months we managed to build and design our new free addon with outstanding new features  as well as introducing a brand new dungeon leveling guide.

We have proven ourselves to be the leader of in-game guides by bringing you a Dailies & Events a year earlier than Zygor.

We have proven ourselves again by bringing you a Dungeon Guide first and maybe in a years time Zygor will follow us again.

We focus all our energy on our guides and our customers, we don’t waste our time & money by attacking our competitors with empty lawsuit threats and posting on their forums using fake identities.

Zygor promised their customers a TourGuide implementation to their addon and assurance that their actions are morally and ethically correct.  If Zygor no longer owns the rights to TourGuide then this is a lie to their customers and the public, so far they have done nothing with TourGuide other than to use the ownership rights against UltimateWoWGuide.  It seems that Zygor has now returned it to Tekkub after realizing that they have wasted their time & money on Tekkub and Lawyers.  And the evidence above can speak for their morals and ethics.

Zygor Guides Review Scam Dugi $150,000 Lawsuithttp://www.ultimatewowguide.com/blog/dugi-zygor-tekkub-tourguide-150000-lawsuit/125/ http://www.ultimatewowguide.com/blog/dugi-zygor-tekkub-tourguide-150000-lawsuit/125/#comments Sat, 27 Mar 2010 03:32:55 +0000 http://www.ultimatewowguide.com/blog/?p=125 TourGuide has been back online for 4 days which was about the same time we released our new addon, and yet after all the controversy we didn’t hear any official announcement from Zygor or Tekkub, it is as if the issue is being “swept under the rug” so we can all forget it ever happened.

After 3 weeks of on going lawyer discussions I now feel comfortable to disclose the information below.

UltimateWoWGuide.com wish to take a stand that we were within our rights to distribute TourGuide until 18th Feb 2010, any other public statements stating otherwise is false and defamatory against our business for the following reasons.

1. On 7th January 2009 Tekkub gave me permission in writing to specifically sell TourGuide with my guides commercially (I chose those words for a purpose) with the only condition to not sell TourGuide ‘alone’. refer to this screenshot of Tekkub’s permission in writing,

This proves that we are within our rights to distribute TourGuide for commercial use and this also proves that Tekkub’s statements on his website and statement made by Zygor that I never had Tekkub permission to sell, or distribute the TourGuide addon is clearly false and there is an alterior motive as to why they would say that.

2. We also note that Tekkub had published the source code of TourGuide on http://www.github.com. One of the terms and conditions of opening an account with GitHub.com is that by setting the user’s repositories to be viewed publicly, the user agrees to allow others to use that user’s repositories to take a copy of source codes from software programs and develop it independently of that software (‘forking’). A copy of the terms and conditions for GitHub.com can be found at http://help.github.com/terms/.

Tekkub claimed that by “setting a repo to be viewed publicly is like packaging an addon in plaintext files… anyone can view it because there is no mechanism available to prevent them from doing so.”

However this statement is incorrect GitHub.com does have an option to set your repositories as private which is recommended by GitHub if you software proprietary. It is also clearly stated on GitHub and if you chose your repositories to be viewed by anyone (refer to screenshot below), you also declare that is an open source project (see section 1.) And the term forking is commonly known to the programming community here.

I forked Tekkub’s TourGuide repo from github to my own github account in January 2009.  If “forking” wasn’t allowed and if TourGuide is not “open source”, the wrong message is clearly sent to the public by hosting it on as a public repositories without any form of license. There are options in GitHub to protect your software to which Tekkub chose not to use.

3. On 3 April 2009 Tekkub was upset regarding the “forking” of TourGuide, I took action with removal of the public link and clearly stated I was still distributing it in my members area. I offered a solution such as licensing, and modification of TourGuide, these options were a possibility and I was under the understanding that these options were being considered.

We complied by removing the link and suggesting a solution and we were still within our rights to continue distributing as we still have permission, if our final email was unacceptable to Tekkub, then he should clearly state it. Which he didn’t and he admitted “chose not to pursue it“.

4. On 12 December 2009 Tekkub continued to take our donations, and also help us further in modifying by providing a code for TourGuide for our distribution in Dec 09.

This proves that there was no problem with us modifying and distributing the guide.

5. Tekkub also encouraged the renaming of TourGuide “In short, you f*ck with it, find a new name for it.” which was the issue that he had with us.

This further proves that Tekkub is not opposed to people modifying and distributing TourGuide.

6. Even after Zygor’s acquisition of TourGuide, Tekkub is not opposed to wow-pro distributing TourGuide but completely against to what we have done when it is the same thing.  Arguments that this is because wow-pro is not a commercial or non profit website is invalid, the large amount of free traffic that wow-pro received is helped by distributing tourguide which adds to their profit of banner advertising.

Again this further proves Tekkub is not opposed to people modifying and distributing TourGuide for commercial use.

Final comment on Tekkub

Our donation to Tekkub was only $500 and I admit it was far from enough, but the fact remains that it was a donation, something we didn’t have to give and our donation made up almost 50% of money that Tekkub received for the development of TourGuide as a public addon. We were ready to take it to the next level with licensing long before Zygor however Tekkub showed no interest.

On January 2010 I even contacted Tekkub to offer him a monthly sponsorship program to continue his development for TourGuide as a free addon for everyone to use. Tekkub never responded because obviously it was too late as he already sold it to Zygor.

As far as I know we were Tekkub’s #1 supporter, over the year we have also contributed to TourGuide by suggesting features and submitting bugs. I don’t think it was fair for me and others who have donated and contributed in anyway for the public project of TourGuide only to be shut out completely and then accused of copyright infringement in public.

I don’t know why Tekkub would state incorrect statements against us, I  did contact Tekkub to try to get more closure,  however he simply states he does not have the liberty to comment. I have also forwarded him this statement for him to correct or comment before posting publicly on this blog,  he didn’t reply.

Zygor Intention To File a $150,000 Lawsuit Against UltimateWoWGuide

1. On 18th Feb 2010, after Tekkub’s confirmation of Zygor’s acquisition of TourGuide on his website tekkub.net, we promptly stopped selling our leveling guide and complied with Zygor’s demands, as this was the only proof that we found that Zygor have acquired the rights to TourGuide.

2. On 22nd Feb 2010, I received a follow up letter from a Lawyer representing Zygor Guides LLC of their intention to file a lawsuit for $150,000 per infringed work and attorney’s fees.

To summarize, they state that.

  • I have infringed their copyright of TourGuide for the period of 12 Dec 2009 to 2 Feb 2010 (Period of just over 2 months)
  • I must pay $75,000 by 31 March 2010, and Zygor guides will agree not to bring the lawsuit against me.
  • I must agree to forever cease the use of TourGuide in anyway.

3. On 24th Feb 2010, Zygor filed DMCA claim against all of our YouTube videos. Videos that we created ourselves 100%, even the free how to do dailies videos that we put out, refer to picture below. The alleged infringing material consist of  an Blizzard’s icon image and quest name to which probably made up less than 1% of the total image.

4. On 5th Mar 2010 I responded with a letter from my lawyer stating that

  • We received the infringement notice prematurely and have already ceased distribution despite having permission from the original author.
  • We notified them that we will not pay $75,000 as it was unjustified and without merit.
  • We requested them to drop the matter because no copyright infringement was made against Zygor Guides LLC and we had already complied by removing traces of TourGuide from our server.

5. On 12th Mar 2010 Zygor’s Lawyer replied with additional demands instead.

  • Zygor’s lawyer finally provided proof of contract agreement between Zygor and Tekkub.
  • Zygor demanded that I agree to permanently cease and desist from reproducing, distributing, displaying and selling the TourGuide software or anything substantially similar to it. (meaning I must agree to never make / sell / give away any in-game leveling guide in any form ever again)
  • Zygor would reconsider the payment of $75,000 if we provided them with our full sales stats.
  • Zygor is open to alternative settlement if I contact him directly via email, if we don’t contact them to settle then they expect a check of $75,000 by 31 March 2010.

6. We sent the follow up letter on 25th Mar 2010, stating further evidence that we were within our rights to distribute TourGuide prior 18th Feb 2010.

Final Comments on Zygor

From the information I have,  Zygor obtain the rights to tourguide in 18th  December  (incorrectly stated as November in the screen shot below) and intentionally not notify ultimatewowguide.com or anybody else.  So they can wait for 2 months to gain some sort of legal grounds for suing ultimatewowguide.com  and maybe others  for 2 months worth of loss of income (refer to screenshot below)

Our current views remains that Zygor purpose of acquiring TourGuide is an intentional attempt to harm our Business and our affiliates incomes to force them to switch. Also an attempt to obtain $75,000 from ultimatewowguide.com

I would like to comment futher however I prefer to stick to facts that I can back up with evidence.  The purpose of this post for you to know the facts and hopefully regain your confidence with ultimatewowguide.com

I look forward to continue developing our own guides and addon and simply minding our own business.

Dugi: Hi Everyone this is Dugi from UltimateWoWGuide.com, not sure if anyone though I have the guts to come and post it here.

main reason for me to post here is which what I have always wondered where things went wrong.

Things turned sour when UltimateWoWGuide.com began to post graphs comparing their products to Zygor products in a way that portrayed Zygor Guides products as being dramatically inferior to Dugi’s products. We didn’t understand what possessed the owners of UltimateWoWGuide to take such a stab at us for no reason but it was clear from then on that they were not interested in any sort of affiliation.

So John is this the real reason that started this whole thing? it seemed so stupid. What graph are you talking about? do you meant the X and Ticks comparison that you have about Joanna, Brian Kopps, TeamIdemise and Our Guide?

I learned this practice from you when you first put it up, and we simply followed, we also made sure everything was accurately stated. We were fine with it on our side because it was accurate but if you wanted it down all you had to do was ask. Just like we have ask you many times, but you never response to our emails, I’m not a mind reader, why don’t you ever contact me John and settle it this professionally.

I contacted you so many times for us to do business together, which would have worked so well. But I again I had no idea there was some sort of grudge, which was odd because you set the standard yourself.

Zygor: Dugi, unfortunately, this issue, combined with past issues we’ve had, have simply escalated too far. We made an effort to keep all of this strictly professional by having our legal team contact you directly behind the scenes, so as not to advertise your inner business workings like this. And then this issue turned into a circus with the blog posting, and continued distribution of our software, which you still have not ceased.

So, we do not have any interest in further debating this with you on our public community forum. We will return to treating this issue strictly professionally and allow our legal team to handle it from here on.

Dugi: Your own members already though your actions were underhanded before my blog was live. How can we resolve a problem if we don’t communicate with each other,  I’m an old fashion man if I have a problem with someone I talk to them directly not hiding behind lawyers.

You only gave us 48 hours to comply with your demands, you know well that will cripple our business income and other website owner. If you don’t consider you actions low-down, dirty, mean, hateful, or anything similar. (that was quoting his own words in the post) .

If you’re really the nice guy that you portray yourself to be, please allow us at least two weeks from now to give us time to adjust and build a new guide.

However my final post was deleted and the thread is now locked and I’m not surprised.

First of all I’m glad to receive any sort of closure from Tekkub,  there’s something about me that makes people never want to contact me directly.

Now I finally understand the series of event that lead up to this,  I can only describe it as a series  miscommunication which I think both me and Tekkub are at fault,  I have learned from it and will move on.

Tekkub’s Comment on his website

http://tekkub.net/2010/02/18/clearing-the-air.html Tekkub: Our first contact was back in Jan ‘09. He asked me if he could sell “tourguide data”, specifically citing his own guides which he was translating into another language. He wanted this guide to plug in to TourGuide. I told him his addon is his property, he can do whatever he wants with it. I shamelessly included a link to pledgie, and he made a donation some time later. Around this time he also used my static HTML generator, which was publicly available on GitHub, to convert his guides to HTML. I understood that he would probably sell access to those pages, but as it was generated from his guide data I really didn’t pursue the matter.

Before we started I contacted Tekkub

Dugi > Tekkub : Hi Tekkub, I was planning to translate my leveling guide into a different language and have it setup to use with tourguide, you don’t have any condition of use with tourguide, but I though I ask you anyway first, so I was wondering if it is ok for me to resell tourguide data commercially.

Tekkub > Dugi: Your addon you write is yours to do with as you please, just don’t sell TG alone.  I.E. you can include it with yours since it’s needed, but you’d be better off pointing people to the official download so they get the most up to date version.

And if you want to donate back a bit of what you make, that’s like good kharma or some shit.

My original intent was only to sell a translated guide for TourGuide,  since the english version would conflict with his free version. He also said I can even inlcude TG with it.  So my conclusion was  Tekkub seemed ok with it,  so I though if the english version was also different he’d be ok with it too.
My initial impression of Tekkub response was that he was a pretty relax I mentioned specifically mention that there was no TOS that comes with tourguide, and that I will sell it or commercial use.  I though if there was specific issue or that he’d want to licence it for commercial use he would have told me then.
Few weeks later we release our version of leveling guide using TG,  however due to the popularity of WoWMatrix  (also because we recommended WoWMatrix to our own customer in the past)  many of our customer would use WoWMatrix to update TourGuide and every time they do this the default leveling guide that comes with TG would be re-installed and confuse our customers.
Renaming the TourGuide addon was our solution, we did this not out of disrespect to Tekkub and his work or to label  it as our own brand but to prevent our guide be confused with the build in TG guide.  My mistake was that I should have cleared it with Tekkub first,  later Tekkub contacted me

Dugi expressed concern over the included guides “confusing” his users and did mention licensing, but I did not pursue the matter. I was not interested in doing business with someone that would rebrand my code without permission, or without even asking. Simply put, he should have come to me about licensing before he started selling his guide.Dugi never removed his viewer, even after I asked him. He now asserts that he had permission to do so from me. He did not.

Tekkub > Dugi : It looks like your site is hosting it’s own version of Tourguide (The base addon, not guides for it) with a modified name.  I ask that you remove this and simply link to the real Tourguide download on wowinterface.  Tourguide is not licensed for you to redistribute it in that way, and I really don’t want to be a dick and pull all that copyright bullshit.

Dugi > Tekkub : Hi Tekkub, The reason we did this, is that to prevent our members to download the default tourguide files via wowmatrix and confuse it with the guide they purchase from us.

I’m not in a position to make request and it is up to you but it would be great if the tourguide base is seperate from the guide. This makes it easy for them to select and deselect guide they want to view.

or can I offer you a donation or license fee, to keep it the way it is, and I will remove the public link as I have already, and make the base addon download members only, to prevent confusion.

: It’s certainly a possibility for me to put out a version without the guides, I just don’t want “unofficial” versions of TourGuide out there.
UltimateWoWGuide had a public link to download the addon from the front page,  after tekkub contacted me I removed it and  the final above statement was all the response I have received from Tekkub regarding the matter.  I was waiting for him to release a TourGuide  without build in guides in Curse or WoWInterface or further instruction from him or whatever it takes for us to be able to use it the way that we’re currently using it.
Time went pass and I still received no response or further instruction from tekkub, the issue kind of got forgotten about. I made the assumption that he no longer care  about the issue. I was wrong.
I didn’t know Tekkub have held some sort of grudge towards me because of this but I did ask for his permission, I did send him donation to support the addon before we begin sellingI did ask for Licencing.

What  I didn’t ask is to rename the addon which obviously really pissed him off and now he is punishing me for it.
Overall this is my mistake for not making things 100% clear with Tekkub before I do anything, he seemed like a relaxed guy judging by his attitude in his email, I made too many assumption that everything was fine between us and Tekkub.
Our final donation to Tekkub was on 12 Dec 2004  and it was a considerably more  than our first very close to the time of Tekkub selling TG to Zygor.  I swear that everything that I have just written are true, I still have the original emails and I doubt Tekkub would disagree.
From this point Tekkub was friendly and helpful.  He tried to help me work out a problem regarding waypoint arrow not working in the Deathknight starting zone.  So if there was still any problem he certainly didn’t make it clear.

John Cook claims that Zygor Guides have bought the rights to the public addon TourGuide which we used as the based addon for our leveling guide viewer. And they are demanding that we remove the modified TourGuide addon that we use from our website to Which we must comply. This news came at a very short notice for us to react.

As for our history with TourGuide, we have written permission from the author of TourGuide known to us as Tekkub Stoutwrithe to sell guides for the addon, he was also aware that we distribute a modified version and he was fine with that. As far as we know he is not affiliated with Zygor at all. We have also been donating money to Tekkub to support the addon, but recently Tekkub have stopped updating his TourGuide and removed it from his public github and website such curse and wowinterface. He has also stop responding my emails regarding TourGuide.

I wouldn’t be surprised if Tekkub have received a large sum of  money from John Cook (Zygor) and signed some sort of agreement to not disclose any information regarding this hand-over to anybody, as he didn’t leave any statements anywhere.

We’re still waiting to see the proof documents regarding the hand-over of TourGuide to Zygor before we will fully comply with their demands.

It is strange that Zygor acquired the rights to TourGuide when they have already developed their own leveling guide addon, my guess is that the sole purpose of all this is to eliminate all their competition that use the TourGuide addon (Dugi, TeamIdemise, Spugnort, Penns, Gavin)

I am amazed and disgusted that Zygor would go into such length of actually investing money in an effort to eliminate competitors and monopolize the market. I guess this is what they call ‘healthy competition’. My definition of ‘healthy competition’ is sending more time & money into improving the product and marketing, not by attempting to sabotage your competition.

I’m dissapointed that this was the mentioned ‘Atom Bomb’, I actually though they were finaly going to release a Daily Quest guide that they promised their customers almost a year ago.

Coincidently we have already begun building our new addon from the ground up before John Cook filed his DMCA complaint, so we’re not too stressed about the whole situation. Our aim is to make it better that TourGuide with a lot of new features that I wish we had previously, we’re hoping to release it by next week.  So its official that Dugi’s Guide v4 is coming soon!

    at the moment we’re focused on getting the addon working 100% with new ui design and also better guide selection menu. Then we will focus on new things like Auto Translation and linking chain quests.
